After months on the market you have finally sold your house, your purchaser’s bond has been granted and you are ready to start the transfer.

Then the Conveyancer asks you for the Title Deed for the property and your heart sinks …. you have no idea where it is.  All is not lost, however, as the Deeds Office Regulations provide for a mechanism whereby you can apply for the issue to you of a certified copy to replace the lost original.  However, the process can be long and tedious and if the procedures are not followed correctly, you can loose the offer on your home.

Important steps and information to consider?

  1. An affidavit signed in front of a Commissioner of Oaths must be completed. The affidavit must contain certain and specific information.

  2. An advert must be published in a local newspaper circulating in the area where the property is situated.

  3. There may be additional procedural requirements depending on the municipal district the property is situated in.

  4. No information can be given to any applicant by the deeds registries acting on a letter, email or via a telephone call, meaning you have to visit the Deeds Office.

This process can be time consuming and expensive if not done correctly.
